Terms & Conditions

These terms govern your use of the Allotix website and the Allotix elective allocation service, provided by PankoByte. By using Allotix, you agree to them.

1. The agreement

These terms are between PankoByte ("we", "us") and the institution or person using Allotix ("you"). If you are agreeing on behalf of an institution, you confirm you are authorised to bind it, and "you" means that institution.

A separate signed agreement or order form with us takes precedence over these terms where the two conflict.

2. The service

Allotix is a hosted system for running controlled elective allocation: configuring allocation events, importing academic data, collecting student preferences, running allocation, and publishing results. We provide it on a subscription and prepaid credit basis.

We may improve, change, or retire individual features. If we discontinue something material that you rely on, we will give reasonable notice.

3. Accounts and access

You are responsible for the accounts you create, for keeping credentials confidential, and for what happens under those accounts. Set roles appropriately: administrator accounts can change allocation configuration and see student data. Tell us promptly at [email protected] if you believe an account has been compromised.

4. Credits and payment

Allocation capacity is bought as credits. Credits are consumed based on the number of students processed in an allocation event. Configuring events, importing data, and collecting preferences do not consume credits.

  • Credits are prepaid and are not transferable outside your account.
  • Credits do not expire and carry forward across events and departments.
  • Prices are those shown at the time of purchase. Taxes are added where applicable.

Refunds and cancellation are covered by our Refund Policy, which forms part of these terms.

5. Your data and your responsibilities

You keep ownership of everything you put into Allotix — student records, courses, capacities, eligibility rules, and results. You grant us the limited right to process it in order to run the service for you, as set out in our Privacy Policy and Data Processing & Security page.

You are responsible for:

  • Having the right to upload the student data you import, and telling students how their data is used, as your local law requires.
  • The accuracy of what you configure — courses, seat capacities, eligibility rules, and student records. Allocation results follow the rules and data you supply.
  • Reviewing allocation results before publishing them to students.

6. Acceptable use

You must not:

  • Attempt to breach or probe the security of the service, access accounts or data that are not yours, or bypass access controls.
  • Reverse engineer, resell, sublicense, or offer the service to third parties as your own, unless we have agreed to it in writing.
  • Upload malware, or use the service to send unlawful, harassing, or deceptive communications.
  • Interfere with the service's operation or place a deliberately excessive load on it.

We may suspend access if we reasonably believe this section is being breached, or if there is a security or legal risk in continuing. Where practical, we will warn you first.

7. Intellectual property

We own Allotix — the software, its interfaces, branding, and documentation. These terms give you a limited, non-exclusive, non-transferable right to use it during your subscription. Nothing here transfers ownership of the software to you, and nothing transfers ownership of your data to us.

If you send us feedback or suggestions, we may use them to improve the product without owing you anything for it.

8. Availability and support

We work to keep Allotix available and to support you through the allocation cycles that matter. We may take the service down for maintenance, and we will try to schedule it away from active allocation windows where we can. Unless we have separately agreed a service level with you in writing, the service is provided without a guaranteed uptime commitment.

9. Warranties and disclaimer

We will provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, Allotix is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that allocation outcomes will suit every academic policy — the outcome depends on the rules and data you configure.

Allocation decisions remain yours. Allotix executes the allocation rules you configure. It does not make academic policy for you, and it is not a substitute for your own review of results before they are published to students.

10. Liability

Nothing in these terms limits liability that cannot be limited by law — including for fraud, or for death or personal injury caused by negligence.

Subject to that, we are not liable for indirect or consequential loss, loss of profits, loss of goodwill, or loss of data that you could have avoided by keeping your own backups and exports. Our total liability arising out of or in connection with these terms is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.

11. Term and termination

These terms apply for as long as you use Allotix. Either of us may terminate for material breach if the breach is not fixed within 30 days of written notice.

On termination, your access ends. Export your data before then — we provide export tools for exactly this. After termination we handle remaining data as described in our Data Processing & Security page. Unused credits are handled under the Refund Policy.

12. Changes to these terms

We may update these terms. If a change materially affects your rights, we will notify account administrators by email or by notice in the product before it takes effect. Continuing to use Allotix after that means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them. Before starting proceedings, we ask that you contact us at [email protected] so we can try to resolve the matter directly.

14. General

If any provision of these terms is found unenforceable, the rest continues to apply. Our not enforcing a right is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor of our business.
